Customs corporation Cheong Sol Law Firm signed MOU with 32 foreign customs corporations which signed FTA with Korea in 2014. As a result, the firm secured its professionalism in the field. Approximately 30% to 40% female figures from Judicial Research & Training Institute in the law society are serving in the fields of real estate, medicine and family law. Moon, on the other hand, jumped into the field of customs and import & export for SMEs. Moon said "I started my career the field in 2012 and provided solutions to lawsuits relating to customs. As a result of activation of FTA, tariff can be lowered and production cost can be increased but it can only be done based on the fact that the country of origin of the imported goods must be the FTA contracting party. For example, if goods are made through OEM Production in various countries regardless whether it is full products or half products, the related companies can be bombed with unexpected tax because it is regarded as a change of the country of origin. Therefore, they need to have proper information about the tax and this is the point where we can provide comprehensive services covering from the decision of the country of origin, verification to legal action." Moon points out that most customs related law suits are for major law firms such as Kim & Chang or Sejong and SMEs are well left out from the benefits as a result. But the disadvantages of major law firms in this case is that they act within the boundary of major companies and they often lack of specialists in customs law. These specialists are particularly important when it comes to actual law suit as it involves a lot of laws and regulations of home and abroad." This is the reason why Moon established Cheong Sol Law Firm and currently they digest about 20 cases a month. A law suit usually is a long term battle and for this reason, Moon and her colleagues are working day and night by gathering field-centered information and solutions.
Passionate activities in customs conflicts and law suits
Cheong Sol Law Firm is specialized in customs. Moon said "we are currently involved in 4 or 5 cases of domestic companies. One of memorable cases was when we dealt with the letter of credit fraud skirmished between Korea and Taiwan. The latter sent terrible products which were not salable in the market at all but the former had to pay for the letter of credit worth $6M to $7M based on the Uniform Customs and Practice for Documentary Credits. For the Korean part, it was an utterly unfair situation. Though we reduced some of the damages through Korean Court's injunction in payment suspension, this marked as a good lesson to the industry to build international corporation through specialists", adding that "we thoroughly screen on each case with various angles. We fight for winning and we achieve it through correct evidence and testimony gathered from numerous meetings with our clients."
Meanwhile, Moon is serving as an advisory solicitor at Seoul Main Customs and a member of Advisory Committee at World OKta. For the last three years, Moon dealt with almost every customs cases of SMEs and has numerous experience in foreign exchange-related cases. Foreign exchange regulations are very complicated and Moon sometimes studies the regulations to find solutions for her clients. This does not surprise us considering the fact that Moon also finished FTA Specialist Practice at Seoul National University and Tax Strategy at University of Seoul. Moon said "I enjoy my work. I receive a good feedback from my clients whenever I give them a piece of knowledge on customs." There has been steady increase of import & export companies and so has related conflicts. For this, Moon is planning to hire more specialists. Moon took the initiative in appointing a solicitor in customs cases in the time where the idea was not regarded as normal. Moon said "I will establish Korea's first customs-only law firm to pioneer the field."
