반짝이는 스타는 연예계에만 있지 않다. 연예인들과 악플러, 방송사의 오보가 얽히고 설켜 세상을 떠들썩하게 만드는 사건들 마다 마주치게 되는 이재만 변호사. 그는 동아, 쌍용, 삼성 그룹 등 기업사건 뿐 아니라 주병진, 송일국, 김현중, 주지훈, 권영찬, 엄앵란, 장은영, 정애리 등 수많은 유명인 사건에서 기존의 편견을 깨고 진실을 밝혀내어 승소를 이끌어냈다. 대중에게 친근한 변호사 중 아마 그 만큼 타이틀이 많은 이는 없을 것이다. 무죄제조기, 법정의 승부사, 연예인의 수호천사 등 수많은 별명으로 언론의 헤드라인을 장식해온 법조계의 스타 이재만 변호사를 만나 세간에 화제를 모은 사건을 중심으로 그만의 승소 노하우를 들어봤다. 

승소 노하우 1: 오만과 편견을 버려라, 세상을 떠들썩하게 한 “대한민국 만세 사건”
법정은 한 치의 양보도 없이 치열하게 쟁점을 가지고 다투는 곳이지만 결국 누가 거짓말을 하고 누가 참 말을 하는지 밝히는 곳이다. 인간은 겉으로 보이는 모습과는 정반대의 얼굴을 가진 이들이 있어 세상을 혼란스럽게 한다. 이재만 변호사가 승소한 ‘대한민국 만세 사건’은 세상의 편견과, 편견을 이용하려 했던 거짓말쟁이를 밝혀낸 통쾌한 사건이다. 
“평범한 중년 아버지가 대학생인 아들이 억울하게 구속됐다며 하소연했습니다. 구치소로 가 아들을 접견했을 때, 아들은 아무 말도 못하고 서럽게 울기만 했고 그 울음이 너무 구슬퍼 더 이상 면담이 불가능해 사무실로 돌아왔습니다. 이것은 한여름 밤에 발생한 여고생 납치 특수강도 사건이었습니다.” 지목된 용의자는 8명의 노랑머리 남자들이었다. 여고생이 노랑머리 중 그 대학생을 범인으로 지목했다. 법정에 증인으로 나온 피해자 여고생은 모범생 스타일의 예쁜 외모를 가진 소녀로 많은 이들의 동정심을 자아냈다. 그러나 이재만 변호사는 여고생의 실체를 밝혀낸다. “사건을 조사하는 도중 드러난 여고생의 실체는 경악 그 자체였습니다. 동거 중인 자신의 남자친구와 만나기로 한 한밤중에 다른 남자를 만난 것을 감추기 위해 그 시간 노랑머리에게 특수 강도를 당했다고 허위신고를 한 것이었습니다. 정말 놀랍지 않습니까?”
노랑머리 범인은 처음부터 존재하지도 않았는데, 문제는 공교롭게 그 대학생이 노랑머리를 하고 있어 여고생의 허위 진술로 인해 억울하게 구속이 된 것이었다. 첫 접견 때 말을 못하고 꺼이꺼이 소리를 내며 울었던 이유가 그 때문이었다. 아들의 무죄를 믿었던 아버지는 법정에서 무죄판결이 선고되는 순간 두 손을 번쩍 들고 ‘대한민국 만세’를 소리쳤다. 이 사건은 사법연수원 시험문제로 출제 될 정도로 화제가 되었고, 실화극장 <죄와 벌>이라는 TV 프로그램에서는 일명 ‘노랑머리 사건’으로 드라마화 되어 재조명을 받았다. 
“요즘에는 죄인들의 수법이 날로 정교하고 지능적이라 법조인이 경험만을 믿고 타성에 젖어있게 되면 오히려 그들에게 당할 수 있다는 것을 기억해야 합니다.”

승소 노하우 2: 정교한 입증과 변론 전략을 수립하라, “송일국 명예훼손 1억 손해배상 사건”
1년에 백만 건이 넘는 사건이 법정에서 다루어진다. 모든 사건은 현장조사 혹은 수사기록으로 남겨지고 이것을 토대로 공방전이 이루어진다. 그러나 유명인의 경우 기록에 대한 진위가 밝혀지기도 전에 언론플레이를 통해 사회적 매장을 당하는 경우가 있다. 진실의 입증과 정교한 변론을 위해서는 보다 철저한 현장조사와 수사기록 검토가 필요하다. 대표적 예가 드라마 <주몽>으로 최고의 한류스타가 된 탤런트 송일국이 프리랜서 여기자를 폭행했다고 고소당한 사건이다. 여기자는 6개월 진단서를 증거로 목격자 2명을 증인으로 내세웠고, 송일국 측 주장을 들어줄 사람은 본인 밖에는 아무도 없었다.
“6개월 진단이면 전신 기브스를 하고 병원에 누워 있어야 할 정도가 되어야 하는데 여기자는 상처 하나 입지 않은 상태였는데, 여기자 측 목격자 2명의 불리한 위증 때문에 치열한 법정공방을 벌였습니다. 사건의 실체적 진실은 CCTV 동영상에 숨어 있었습니다. 그래서 방송국 장비를 동원해 CCTV를 분석했고, 피해자 주장의 허구를 증명하기 위해서 살을 에는 추운 겨울 날 방송국 크레인 카메라까지 동원해 현장 재현 동영상을 촬영했습니다. 당시 송일국씨는 배우 생명을 걸고 진실을 밝히겠다며 대역 없이 수십 번을 뛰면서 현장 재현을 했습니다.”
 결국, 송일국씨는 1심에서 명예훼손에 대한 1억 원의 손해배상 소송에서 승소해 추락했던 국민배우의 이미지를 회복했다. 이재만 변호사는 2년여의 법정 공방과 수사를 통해 상대방 측의 무고와 위증을 밝혀내었고 결국 송일국의 상해 등의 무혐의 결정을 받아 승소했다.

승소 노하우 3: 위기 대응에 모든 역량을 총동원하라, “김현중 명예훼손 1억 손해배상 사건”
이재만 변호사의 전문 분야 중 하나는 리스크매니지먼트이다. 기업, 단체, 개인 누구든 인생에서 예상치 않은 위기와 만나는데 특히 브랜드를 중요시하는 기업이나 대중적 이미지를 먹고 사는 연예인의 경우 신속하고 적절한 위기 대응에 실패하면 이미지 실추는 물론 경제적으로도 천문학적인 손해를 입는다. 일례로 초미의 관심을 모은 가수 김현중 사건을 들 수 있다. 그는 전 여자 친구로부터 상해죄로 고소된 지 열흘 만에 무려 만 건이 넘는 일방적 언론보도로 이미지에 치명적 손상을 입어 재기불능 상태에 빠졌고, 이듬 해 상대측은 또 다시 폭행과 유산을 이유로 16억 원의 손해배상을 청구했다. 이재만 변호사가 김현중 사건의 변론과 리스크매니지먼트를 맡게 된 것이 이때였다. 
“전 여자 친구의 황당한 주장이 언론에 보도되자 보도 당일 상대방의 언론 플레이에 맞대응하고 증거를 제시해 김현중의 이미지 손상을 최소로 막을 수 있었습니다. 그 후 상대 측 청구는 모두 기각되고, 오히려 김현중씨의 명예를 훼손한 불법 행위가 인정되어 1억 원을 배상하라는 판결을 선고 받았습니다.” 김현중 사건 승소 이후, 남성 연예인의 성문제 관련 사건에 대한 명예훼손과 무고 판결이 속속들이 이어졌다. 이재만 변호사의 승소 판결이 관련 유사 사건의 이정표 역할을 한 것이라 볼 수 있다. 연예인은 일반인과는 달리 과도한 유명세의 대가를 치르게 되는 경우가 많지만 그렇기에 뜻하지 않은 주변의 도움을 받기도 한다. 
“김현중씨는 그의 부모와 팬들이 전 여자 친구의 거짓말을 밝히는데 많은 정보를 주었고, 송일국씨는 어머니 김을동씨와 아내의 적극적 지원이 있었습니다. 또한, 2심에서 판결을 뒤엎어 제가 무죄제조기로 불리게 된 주병진 사건 또한 이성미, 박미선 등 동료들의 믿음과 단합이 있었기에 상대방 측을 자해공갈단이라고 밝혀낼 수 있었습니다.”
밤하늘의 어둠이 짙을수록 별은 빛나며, 새벽이 오기 전이 가장 어둡다고 한다. 이재만 변호사가 전하는 3대 승소 노하우의 핵심은 결국 길을 잃은 어두운 세상의 방향을 잡아주는 별빛과도 같은 것이 아닌가 하는 생각이 들었다. 승소의 힘은 무엇이냐는 질문에 이재만 변호사의 답은 간단했다. “진심은 길을 잃지 않습니다.” 심상한 그의 말이 기자의 마음에는 큰 울림으로 남았다.

Winning Knowhow No.1: “No pride and prejudice”

The court is a place to find out who tells a lie and who tells the truth. Regal battles get confused because of those who have two faces. ‘The Hurrah Korea Case’ that wondered the world was an example of winning case of Lawyer Lee Jae-man of Law Firm Cheong Pa who discerned the honest from the liar. 

“A father appealed that his son was unfairly accused. When I went to the detention center, the son didn’t say anything but only swept sadly and I couldn’t make an interview. He was arrested for abduction and special robbery of a female high school student” starts Lee.

The suspects in total were 8 yellow haired men and the female student pointed the son out. When the student appeared in the court to give a testimony, she aroused sympathy among the audience with her pretty look. But it didn’t work for Lee.

“The truth I revealed about the seemingly pretty student shocked the world. She wanted to hide that she was seeing another man the night she was supposed to meet her boyfriend. So she lied that she was robbed by the son. Isn’t it shocking?”

Basically, the yellow haired men were not even existent but the son accidentally had a yellow hair. He was so gobsmacked what on earth had happened to him and that’s why he wept so bitterly. His father had a firm belief that his son never could be such a criminal and shouted in joy with his hands sky high “Hurrah, Korea” when the verdict was delivered in his son’s favor, thus named the case ‘The Hurrah Korea Case’. The case became so popular that it has appeared on the bar exam and was made into a TV drama <Crime and Punishment>. 

“So what lesson we, the judicial officers, should learn from the case is that we need to be cautious not to be two proud or prejudiced.” 

Winning Knowhow No.2: “Thorough proof and defense”

About a million cases are brought to the court a year. Each case is left recorded and there is a fierce offensive and defensive battle. If the case comes to celebrities, things become more complicated as the media butt in and flood out the stories, right or wrong, that sometimes take part in pushing the affected celebrities to kill themselves. This is the point where the proof and defense skills, based on thorough field investigations and record analysis, come to play a crucial role. A good example is the assault case of Song Il-gook, who rose to fame through the drama <Jumong>.  He was accused of assaulting a female reporter. The plaintiff submitted a medical report stating a 6 month medical treatment alongside 2 witnesses. All stood on the plaintiff’s side except Song himself at first. 

“In common sense, the 6 month treatment should have made her hospitalized but not a single wound was found on her body but the testimonies of the 2 witnesses caused a fierce offensive and defensive battle. The truth, however, was hidden in the CCTV. I analyzed it with the help of specialists and I reproduced the spot where the alleged assault took place with crane cameras in cold winter. Song himself was determined to reveal the truth by staking his career as an actor.”

To sum up, Song won the case with filing back a case against her for libel with 100 million won ($88,896) compensation and recovered his image as a star actor. The case took 2 years.

Winning Knowhow No.3: “Risk management”

Risk management is one of Lee’s specialized areas. Everybody face risks and the damage is harsher when it comes to companies and celebrities because they have more to lose if failed the risk management. 

A good example is the case of singer Kim Hyun-joong. His girlfriend accused him of assault and the media, like fishes on the land getting into water, streamed a whacking 10,000 reports which damaged Kim not able to appear on TV again. The next year, the girlfriend sued him again for assault and miscarriage with 1.6 billion won ($1.4M) compensation. 

“I tried to minimize the damage on his image with evidence against the media from the very first day of the absurd asserting of the woman. In conclusion, all the claims of the women were rejected in the court and she was accused of libel and had to compensate 100 million won.”

It was this time that the celebrities’ sexual assault cases were started to conclude in false accusations and libel one by one. In other words, Lee’s winning the celebrity cases played a milestone. 

“Kim’s parents and friends provided a lot of helpful information to reveal his girlfriend’s lie. Song’s mother Kim Eul-dong and his wife also played a great part to solve the case in Song’s favor. I once took the case of Ju Byeong-jin and I was called ‘innocence manufacturer’ by reversing the second judgment because I proved the accuser as a fraud ring. His colleagues Lee Sung-mi and Park Mi-sun also gave a lot of support to win the case.” 

When asked about the secret of his winning apart from the three knowhows, Lee said “Truth never lose its way”.
